The Philippine National Police (PNP) issued a PNP Memorandum
Circular 2014-004 dated February 4, 2014 entitled “Updated Guidelines and Procedures in the Handling of Mandatory ATM Pay
and Allowances Accounts of PNP Personnel with the Landbank of the Philippines.”
This is to remind all PNP personnel that their PNP ATM card issued by PNP
Finance Service is part of the PNP uniform and should always be in the
possession of each PNP member AT ALL
TIMES.
The PNP through inspection team will conduct regular or
surprise random inspections to all PNP personnel in compliance with Tamang
Bihis.
The purpose of inspection of ATM card is to prevent PNP
personnel from pawning ATM to their creditor.
Is there a sanction/s for failure to comply the above memorandum?
(A resounding Yes!)
The PNP ATM card, being part of PNP uniform like issued
firearm and PNP Identification card (PNP ID) must be in their possession at all
times, non-transferable and surrendered only upon retirement or separation from
the service.
Any member of the PNP who violated the said directive
will be liable for:
a) Simple Neglect
of Duty under Rule 21, Section 2 paragraph A (1) of NAPOLCOM Circular No.
2016-002, for failure to report in prescribed uniform with badge,
identification card, service firearm and other
required equipment, except those not required to wear the prescribed
uniform by reason of exigency of the service; and
b) Less Grave
Neglect of Duty under the same circular, for willfully violated office regulations and/or refuse or neglect to comply with
said provisions.
If police officer proven to be liable in any of the
above cited offenses, then the penalties shall be made in accordance with their
respective ranges:
1) For Simple Neglect of Duty – PNP personnel can be
suspended with a minimum penalty of 1 to
10 days, medium penalty of 20 days
and a maximum penalty of 30 days.
2. For Less Grave Neglect of Duty – PNP personnel can
be suspended with a minimum penalty of 31
to 40 days, medium penalty of 50
days and a maximum penalty of 59
days.
All penalties mentioned include withholding of
privileges or forfeitures of salary. According to the Circular, when we say
withholding of privileges it simply means deferment of vacation leave privileges,
participation in training grants or program and other similar privileges normally
enjoyed by civil service employees.
Also, the allowable minimum
take home pay of PNP personnel is ₱9,650 (for uniformed personnel),
broken down as follows:
a. ₱5,000 from the base
bay; and
b. ₱4,650 from the subsistence
allowance
For Non-Uniformed
Personnel (NUP), the minimum take home pay of is ₱5,000.
If a police officer deliberately used his/her ATM card
in some other purpose like depositing as collateral to obtain a loan or
deceitful personal interest then he will be held liable for Less Grave Neglect
of Duty for willfully violate office regulations.
Meanwhile, Rizal Representative Fidel Nograles filed House
Bill 4888 which seeks to amend Republic Act No. 9262
or the Anti-Violence Against Women and their Children Act to cover abused
Husbands. If this bill becomes a law, wives who keep their husbands’ ATM
payroll cards could be held liable for economic abuse.
Rep Nograles said a classic example of this is a traditional
way of seizing husband’s ATM card, then depriving him of the chance to decide
on his spending.
This is to remind all PNP wives, girlfriends, and relatives that if you confiscate your husband/partner’s ATM card, you will suffer the consequences because, by the time he serves the suspension for violating the aforementioned circular, he will be disqualified from receiving bonuses (hazard pay, mid-year and year-end bonuses, etc.).
